Warranty

A BushRanger camping trailer includes components from third-party manufacturers, some of which provide separate operating instructions, warranties and information relating to their products. This information will be included with your purchase documentation. Some information relating to the operation of these components may be provided herein, however no responsibility is taken by Kakadu Camping Inc. and/or its dealers as to the validity of such information, and is provided as a courtesy only.

It is important that you refer directly to the manufacturer of such components for any information relating to product design, performance, specifications, safety, operation, warranty and maintenance.

OZtrail® Tent Sections — 2-YEAR NON-TRANSFERABLE LIMITED WARRANTY

This OZtrail product is warranted for two years from date of purchase. OZtrail agrees during the warranty period to repair any manufacturing defects in the product or, at its option, replace the product with another product or an equivalent product without cost to the owner for material or labour. Proof of purchase, including the purchase date will be required. Exceptions include fair wear and tear, damage caused by improper use, misuse or abuse. Commercial users are not covered by this warranty.

Please note the shipping charges to and from the OZtrail warehouse or the original place of purchase are not covered under warranty and are the responsibility of the purchaser. Charges for the removal from trailer and refitting to the trailer are the responsibility of the purchaser.

CARING FOR YOUR GALVANISED STEEL POLES, POLE JOINERS AND ZIPS

Your OZtrail steel poles have been hot dip galvanised to provide long life with minimum corrosion. Salt, sand, dirt and water are the enemy of any steel product and zip. Make sure the poles and zips are always clean and dry before storage. When the poles and zips have been used in damp, dusty, sandy or salty conditions they must be cleaned and coated with a thin film of oil or silicon based liquid spray before storage.

Many of the frame poles are connected with pole joiners which are designed to keep your poles organised and to allow quick assembly of the pole frame. Over stretching or dropping the poles will easily damage the pole joiners and this is not covered by the warranty. Please make sure you handle the poles carefully, especially when unpacking and packing away into the carry bag. The impact of a pole hitting the hard ground can easily damage the pole joiners.

INSURANCE, YOUR PROTECTION AGAINST THE UNEXPECTED

Most people have product problems from unexpected sources. Extreme weather is a good example of an unexpected problem. Make sure that you list your expensive camping products on your home and contents insurance policy. Most good insurers will cover accidental and storm damage to your Camper Trailer Tent that falls outside this warranty.

WARRANTY REGISTRATIONS

An owner is solely responsible to complete and deliver warranty registration records to any third party supplier or manufacturer of materials, components or other parts of a trailer.

For the warranty, the selling dealer will help an owner to fill out the Kakadu Camping Inc. Warranty Registration Card (the “Registration Card”). That form must be returned to Kakadu within 30 days of the owner taking delivery of the trailer. The limited warranty will not be registered with Kakadu unless the Registration Card is completed in full and received by Kakadu. Failure or delay in filing the Registration Card with Kakadu will not affect an owner’s rights under this limited warranty as long as the owner can present proof of purchase of the trailer, but such failure or delay may cause delays in obtaining benefits under this limited warranty and may inhibit the ability of a servicing facility to provide proper repairs or part replacement.

LIMITATIONS, EXCLUSIONS AND DISCLAIMER OF IMPLIED WARRANTIES

ANY IMPLIED WARRANTY THAT ARISES OR IS FOUND TO ARISE UNDER APPLICABLE LOCAL, PROVINCIAL OR FEDERAL LAW, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR ANY IMPLIED WARRANTY OF FITNESS, IS LIMITED IN DURATION TO THE DURATION SET FORTH IN THIS LIMITED WARRANTY AND IS LIMITED IN SCOPE OF COVERAGE TO THE SCOPE OF COVERAGE OF THIS LIMITED WARRANTY.

Kakadu makes no warranty of any nature beyond that contained in this limited warranty. Kakadu does not authorize any person to create any other obligation or liability for it regarding the product, and Kakadu is not responsible for any representation, promise or warranty made by any dealer or other person beyond what is expressly stated in this limited warranty, and no one has the authority to enlarge, amend or modify this limited warranty. Any selling or servicing dealer is not agent for Kakadu, but is an independent entity.

KAKADU SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM BREACH OF THIS LIMITED WARRANTY OR ANY IMPLIED WARRANTY. THIS EXCLUSION OF CONSEQUENTIAL AND INCIDENTAL DAMAGES SHALL BE INDEPENDENT OF ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY WARRANTY, AND THIS EXCLUSION SHALL SURVIVE ANY DETERMINATION THAT THIS LIMITED WARRANTY OR ANY IMPLIED WARRANTY HAS FAILED OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to an owner.

EVENTS DISCHARGING KAKADU FROM OBLIGATION UNDER THIS LIMITED WARRANTY

Occurrence of any of the following events discharges Kakadu from any express or implied warranty obligation, including under this limited warranty, in relation to the trailer:

  • any rental or other business or commercial use or purchase of the trailer (as defined in this limited warranty);
  • any defect in a separately manufactured component part;
  • owner neglect or failure to provide routine maintenance;
  • unauthorized alteration of the trailer;
  • collision or accident, whether or not foreseeable,
  • any acts of weather or damage or corrosion due to the environment, theft, vandalism, fire, explosion or earthquake;
  • overloading in excess of weight ratings;
  • tampering with any portion of the trailer.

LEGAL REMEDIES 

Any action to enforce any portion of this limited warranty, or any implied warranty, must be commenced by no later than six months after expiry of the warranty period. Any performance of repairs shall not suspend any limitation period from expiring. Any performance of repairs after the warranty coverage period has expired, or performance of repairs regarding anything excluded from coverage under this limited warranty, shall be considered “good will” repairs, and they will not alter the express terms of this limited warranty, or extend the warranty coverage period or this limitation period in this paragraph. In addition, this limited warranty is not intended to extend to future performance, and nothing in this limited warranty, or any action of Kakadu, or any agent of Kakadu, shall be interpreted as extending the warranty period or this limitation period.

NOTE: Kakadu does not control the scheduling or completion of service work at its independent, authorized dealerships. An owner may encounter delay in scheduling or completion of such work.

WARRANTY REPAIR PROCEDURE

To obtain warranty service the owner must do all of the following: 
1. Within the period set out in item (2) below, give written notice to Kakadu, or an independent, authorized dealer of Kakadu, of the substantial defect in material or workmanship attributable to Kakadu that arose within the warranty period, providing details about the claimed defect;
2. The written notice under item (1) above must be provided within 30 days of when the owner discovered, or in the sole opinion of Kakadu should have discovered, the claimed defect, and in any event must be provided not later than 30 days after the end of the warranty period;
3. Promptly schedule an appointment with and take the trailer to an independent, authorized dealer of Kakadu, or if directed by Kakadu, to Kakadu, for service under this limited warranty; and
4. Pay any freight or transportation costs, import duties, fees and all incidental expenses associated with obtaining warranty service, and return of the trailer to the owner.

CARE AND MAINTENANCE

An owner is solely responsible properly to care for and maintain the trailer and to assure correct load distribution. For details, consult the Kakadu owner’s manual and the owner’s manuals of other component or part manufacturers or suppliers. Please review all manuals supplied with your trailer, and contact your selling dealership or manufacturer or supplier of the component or part if you have questions.  

Note: Failure to maintain the trailer as noted in those manuals voids this limited warranty, and any damage to the trailer as a result of an owner’s failure to perform such care, is not covered by this limited warranty.
